ToneToteThese Terms of Service ("Terms") form a binding agreement between you and TUSMATIKO. Please read them carefully before using our AI songwriting tools, purchasing credits or submitting creative inputs. By accessing ToneTote, you agree to comply with these Terms.
You must be at least 16 years old (or older where required by local law) and capable of entering a binding contract to use ToneTote. Keep your login credentials secret and notify us immediately of any unauthorized activity. You are responsible for everything that happens under your account.
ToneTote provides AI-powered songwriting, lyric, and creative tools. We may update, suspend, or discontinue any feature at any time. Some functionality may be labeled beta or experimental and may contain defects.
This Section applies to ToneTote song packages and related custom-song add-ons (including, without limitation, personalized lyrics, custom song production, memory video add-ons, and Spotify placement services purchased as part of a custom gift order). By completing payment for such a package, you acknowledge that you have read and agree to this Section.
Each custom song order is produced individually based on information you provide (names, occasion, memories, preferences, and other creative direction). Because production begins upon or shortly after payment and the deliverable is personalized, all fees for custom song gift packages are final and non-refundable once payment is successfully processed, except where a refund is required by applicable law or expressly provided below.
Monetary refunds are not available for dissatisfaction with subjective creative elements (including style, mood, genre, vocal character, or lyrical tone) after delivery of the initial version, except as set out in our revision commitment below or where mandatory consumer rights apply in your jurisdiction.
We are committed to your satisfaction with the creative result. If the initial delivered song does not reasonably meet your expectations, we will provide up to five (5) complimentary revisions per purchased song package, subject to the following conditions:

You retain rights to prompts, lyrics, images, audio, videos, and other inputs you submit. By uploading or entering content you grant ToneTote a worldwide, royalty-free license to host, process, display, reproduce, transform, and technically adapt that content as needed to provide, secure, support, and improve the service. Subject to these Terms and your compliance with applicable laws, you may use generated outputs for personal or commercial projects. To the extent permitted by law, ToneTote does not claim ownership of your generated outputs. However, because AI systems may produce similar or identical outputs for different users, we cannot guarantee uniqueness, exclusivity, copyrightability, or freedom from third-party claims. You are responsible for reviewing outputs, clearing any third-party rights, and ensuring compliance with laws before publishing, selling, distributing, or commercially using any output.

AI outputs can be unpredictable and may contain factual errors, offensive or unsuitable elements, similarities to existing works, references to public information, or content that requires editing before use. Outputs are generated automatically and do not represent our views or professional advice. We do not guarantee that any output will be accurate, unique, original, non-infringing, commercially suitable, or accepted by any third-party platform. You are solely responsible for reviewing, editing, verifying, and deciding whether to use or publish any AI-generated output, including complying with disclosure, copyright, publicity, privacy, advertising, and platform rules.
ToneTote (and its licensors) retain all rights to the platform, models, prompts, documentation, and brand assets. These Terms do not grant you any ownership interest in ToneTote’s IP. You agree not to use our trademarks without permission.
If you submit ideas, feature requests, or bug reports, you grant us a perpetual, irrevocable license to use that feedback without attribution or compensation.
We may suspend or terminate access if you breach these Terms, misuse the service, or if required to do so by law or third-party providers. You may close your account at any time. Sections relating to ownership, disclaimers, limitation of liability, and dispute resolution survive termination.
The service is provided “as is” without warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, ToneTote and its suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data. Our total liability for any claim will not exceed the amounts you paid in the 12 months preceding the event.
These Terms are governed by applicable law. If local consumer law in your jurisdiction provides additional rights, those remain unaffected.
We may modify these Terms from time to time. We will post the updated version and change the “Last updated” date. Material changes will be communicated via email or in-product notice. Continued use after changes constitutes acceptance.
